Why has the UK law changed?

Article 5(3) Directive 2009/136/EC, which states that website visitors should actively consent to use of internet cookies prior to them being downloaded on the users’ machine, was enforced for all EU member states to implement in reasonable time.


The UK government has taken one of the first steps to introduce this law ahead of other EU countries. The Information Commissioner’s Office (ICO), the UK independent authority set up to uphold information rights in the public’s interest, has been given powers from government to regulate this amended law.

 

What did the previous law cover?

The previous law stated that information on a website’s use of cookies should be clearly outlined either under the privacy policy page or under a separate page. The new law takes this approach one step further by ensuring that website visitors understand the use of cookies immediately upon a first arrival on a website.

 

What are the penalties for not complying?

The ICO has given UK organisations until 25th May 2012 to implement a strategy for their websites to comply with the new regulations. It has been advised to start this process immediately rather than later as websites have already been reported to and investigated by the ICO.
